Terms and conditions

These terms apply to all quotes and jobs of Smart Timmerwerk (KvK 94501173). We've written them as clearly as possible. If the quote says something different from these terms, the quote applies. This is a translation; the Dutch version prevails.

1. Definitions

  • We: Smart Timmerwerk, the contractor.
  • You: the client, a private person or a business, who asks us to carry out work.
  • The work: everything we make, supply, install or renovate according to the quote.

2. Quote

A quote is valid for 30 days unless it states another period. It is based on what we see when measuring and on the information you give us. If the situation turns out differently than expected, for example because of hidden defects in walls, floors or pipes, we discuss this with you first before continuing.

3. The job

The job is final once you have accepted the quote in writing or by email. Any agreements that differ from the quote are always recorded in writing or by email.

4. Cooling-off period for private clients

If you, as a private client, enter into the agreement at your home or remotely (for example by email), you usually have a 14-day cooling-off period. If you want us to start within those 14 days, we ask you to confirm this explicitly. If you then cancel, you only pay for the part already carried out. Urgent repairs you asked us for yourself have no cooling-off period.

5. Carrying out the work

We carry out the work skilfully and carefully, as agreed in the quote. You make sure that:

  • we can access the workplace at the agreed times;
  • the work area is clear of belongings that are in the way or could be damaged;
  • electricity, water and a place for materials are available;
  • any permits or permission from a homeowners' association or landlord are arranged, unless agreed otherwise.

Where needed we work with other tradespeople. For larger renovations we remain your point of contact unless agreed otherwise.

6. Additional and reduced work

Want to change or add something during the work, or does extra work turn out to be needed? We first discuss what it costs and how much time it takes. We only start additional work once you agree. Work that is dropped is deducted.

7. Planning

The schedule and completion date in the quote are a good estimate, not a hard deadline. If we are delayed, for example by weather, late delivery of materials or illness, we let you know as soon as possible and agree a new schedule together.

8. Price and payment

For private clients all prices include VAT; for businesses they exclude VAT, unless stated otherwise. For larger projects we may invoice in instalments, as stated in the quote. Invoices are payable within 14 days.

If you don't pay on time, we first send a reminder giving you another 14 days. After that we may charge the statutory interest and collection costs, within the limits set by law.

9. Materials

Materials we supply remain our property until the work has been paid in full. If you supply materials yourself, you are responsible for their suitability and quality. We'll tell you if we have doubts.

10. Completion

When the work is finished, we go over it together. The work is complete once you approve it or start using it. Minor items still to be finished are noted and resolved as soon as possible; they don't hold up completion.

11. Complaints and warranty

Not happy with something, or notice a defect later? Let us know as soon as possible, preferably with a photo, via info@smarttimmerwerk.nl. We take it seriously and repair defects caused by our work. The statutory warranty applies to the work. Any additional warranty we agree on is stated in the quote.

Defects caused by normal wear, incorrect use, poor maintenance or work by others are not covered.

12. Liability

If something goes wrong through our fault, we are liable for the direct damage, up to the amount of the job. This does not apply in case of intent or gross negligence, nor where the law does not allow a limitation. If you notice damage, report it as soon as possible so we can assess and limit it.

13. Cancellation

If you want to cancel a job after the cooling-off period, let us know as soon as possible. We then charge the costs already incurred, such as ordered materials and work carried out.

15. Disputes

Dutch law applies to our agreements. If we can't resolve a dispute together, it is submitted to the competent court. As a private client you may also choose the court that is competent by law in your place of residence.

16. Changes

We may change these terms. A job is governed by the terms that applied when you accepted the quote.
